With increasing cases in recent years of major businesses being fined for employing students or individuals of illegal status due to expired visas (Tesco’s £115,000 fine in 2012 springs to mind), it is more important than ever to ensure you are abiding by Government regulations when employing foreign nationals.
As an employer it is your legal responsibility to make sure all of your employees have the right to work in the UK. If you fail to establish this in every case, you could end up facing serious fines or in worst instances criminal prosecution.
To adequately ensure you are abiding by regulations there is a “3 step process” that should form your recruitment and employment practices. It is important you follow these checks because if it does so happen you employ an illegal worker(s) and are found to, you have adequate defence against receiving a civil penalty.
