The HR Investigation Process Explained

Many employers ask: how do HR investigations work?

A fair HR investigation will usually follow these stages:

  1. Defining the issues

The employer identifies the complaint, allegation or concern and decides what needs to be investigated.

  1. Appointing an investigator

An investigator is chosen to lead the process. In more sensitive cases, this may be an external HR investigator to ensure independence.

  1. Gathering evidence

Relevant documents, emails, policies, messages, CCTV, attendance records or other evidence are collected and reviewed.

  1. Interviewing witnesses

The investigator meets with the complainant, the employee involved and any relevant witnesses to gather factual accounts.

  1. Assessing the evidence

The investigator considers the evidence carefully, identifies any inconsistencies and decides what findings can reasonably be made.

  1. Producing the investigation report

A written report sets out the scope of the investigation, the evidence reviewed, the findings made and whether there is a case to answer.

  1. Next steps

The employer then decides whether no further action is needed, whether informal action is appropriate, or whether the matter should move to a disciplinary or grievance outcome stage.

How Long Do HR Investigations Take?

There is no fixed timeframe for an HR investigation. A straightforward case may take a matter of days or a couple of weeks, while more complex matters can take several weeks or longer.

Timescales usually depend on:

  • the number of witnesses involved
  • the volume of evidence to review
  • whether key individuals are absent
  • the complexity of the allegations
  • whether new issues emerge during the investigation

Employers should avoid rushing the process, but they should also not allow unnecessary delay. A good investigation should be prompt, proportionate and thorough.
