You will recall that our last blog gave details of the newly extended furlough scheme, but we were waiting for full guidance. This is now available and confirms one important issue which you need to know about.
For claim periods starting on or after 1 December 2020, an employer cannot claim for any days on or after 1 December 2020 during which the employee was serving a contractual or statutory notice period for the employer (this includes people serving notice of retirement or resignation).
This will be a relevant consideration for those businesses who have furloughed employees on redundancy notice or were planning on making redundancies in the forthcoming months.
For periods before 1 December 2020 the guidance states that claims may be made if the employee is serving notice.
