Trusts can arise in a wide variety of situations; sometimes expressly, such as within a will, in relation to a charity, or in relation to ownership of a property. Sometimes a trust situation can arise from the circumstances, for example because of a promise or a financial contribution, without the existence of any document setting out the terms of the trust.
In a trust situation, disputes can arise between the beneficiaries of the trust, or between the trustees and the beneficiaries. The dispute could be about how monies or property are being dealt with by the trustees, about the terms of the trust and how trust assets should be used, or about whether the trustees are acting in breach of trust.
